Pay transparency is here to stay, with or without the laws

In the United States, one out of four workers are now covered under pay transparency laws, with the number expected to double as transparency in compensation gains recognition across the nation. 

Colorado, the first state to require employers post pay ranges on job ads back in 2021, is already moving ahead as it expands employer obligations to promote pay transparency.   

The new regulations, which will take effect on January 1, 2024, will require employers to internally announce new hires and promotions and provide information on how employees may demonstrate interest in similar job opportunities in the future. On top of that, the statute of limitations for employees in wage discrimination claims will be extended to six years, from the original three years.  

Under the state’s first-of-its-kind job ad salary disclosure law, close to 30 companies are now under fire for non-compliance, with big names like Tesla Inc. and Twitter making the list. Five companies including the social media company and Lockheed Martin were fined for a total of $237,000 with a penalty capped at $10,000 per violation. 

Benefits of Pay Transparency

With discussions around pay transparency heating up, countries without a legal framework in place yet are beginning to see changes. In Singapore, the absence of formal pay transparency laws did not deter employers from including salary ranges in more than one-third of job postings, according to Indeed’s data, indicating the increasing importance of providing this information to attract potential candidates.

Malaysia has also announced its plan to publish quarterly salary statistics as a means to address salary issues, create a benchmark for the open job market, and foster a more dynamic work environment. This move aims to provide transparency in salary information and assist both employers and job seekers in making informed decisions. 

Expectations for Hiring Today

Employers who embrace pay transparency not only attract qualified top talent but also reap the benefits of reduced employee attrition. Payscale’s research highlights the positive impact of transparent pay practices on employee satisfaction, engagement, and retention. Job seekers are increasingly seeking out salary range information in job ads, with over half of them believing that jobs without pay transparency tend to offer lower compensation.

That said, salary range is not the sole factor in attracting candidates. Intangible aspects like employee well-being, flexibility, and culture are gaining prominence in job posting strategies. A global study by LinkedIn found that job ads emphasizing these factors receive more applications. As job ads serve as the entry point to the hiring journey, it is crucial for employers to ensure transparency and provide comprehensive information to avoid negative candidate experiences.

The prevalence of pay transparency is evident as it transcends legal frameworks. Employers worldwide are recognizing its benefits in attracting and retaining top talent. Whether through regulatory changes like those in Colorado, or voluntary actions in countries like Singapore and Malaysia, pay transparency is becoming an essential component of fair and equitable workplaces. As the job market evolves, employers must prioritize transparency in job ads, incorporating salary ranges and highlighting key factors like well-being and culture to create an engaging and trustworthy recruitment experience.
